While I appreciate the opportunity to participate in the community dialogue, my opinion as to the meaning of the word “mezzanine” is irrelevant in regard to the proper application of the building code. As your attorney may have already suggested, that crucial determination shall be made by those governing agencies that enforce the codes pursuant to the applicable laws. Beyond what is defined by the V.I. Code, the International Residential Code, or the International Building Code, DPNR has also recently distributed a memo specifically on the topic. It is these definitions that are important and so would encourage everyone to fully consider the existing laws, coordinate with DPNR staff, and research the pertinent issues wherever possible so as to better understand their intent and consequence. This has always been useful for me and I trust that it will be helpful for you.
